È stata pubblicata sulla Gazzetta Ufficiale n. 146 di venerdì, 24 giugno, la Legge 21 giugno 2022, n. 78, recante “Delega al Governo in materia di contratti pubblici”.
L’entrata in vigore della Legge è fissata al 9 luglio e da quel momento il Governo ha sei mesi per adottare uno o più decreti legislativi recanti la revisione complessiva della disciplina degli appalti pubblici.
Intanto è stata costituita lunedì 4 luglio, con Decreto del Presidente del Consiglio di Stato Franco Frattini, anche la Commissione che, come richiesto dal Governo, (ai sensi dell’art. 14 della legge istitutiva del Consiglio di Stato) formulerà il progetto del decreto legislativo sulla disciplina dei contratti pubblici, in tempi rapidissimi, già entro il prossimo 20 ottobre.
Termini stringenti per consentire al Governo “una compiuta valutazione politica e i necessari passaggi procedimentali”, trattandosi di una riforma che costituisce un obiettivo del PNRR, da conseguire entro il termine del 31 marzo 2023.
Tale Commissione – come previsto dal comma 4 dell’art.1 della legge 21 giugno 2022, n.78 – è composta non solo da Consiglieri di Stato e dei TAR, ma anche da Avvocati dello Stato, Consiglieri della Corte di Cassazione e della Corte dei Conti, da professori, avvocati ed esperti tecnici.
